Response on the revision of the BÜPF
Open Systems AG is submitting a response as part of the consultation being carried out by the Federal Department of Justice and Police on the total revision of the Law on the Monitoring of Postal and Telecommunications Traffic (BÜPF). In the view of Open Systems AG, the preliminary draft of the revised law has serious legal, organisational and technical flaws and thus needs to be reworked.
The Federal Department of Justice and Police has published a preliminary draft of the total revision of the Law on the Monitoring of Postal and Telecommunications Traffic (BÜPF) and opened it up for public consultation.
The scope of monitoring by the state should be adjusted to take technical developments into account and, in addition to telephony, also cover the Internet, e-mail and Internet telephony.
The intention of the new law is correct and important: Suspected offenders should not be able to use new communication technologies to avoid being monitoring by law enforcement authorities.

The public consultation period ends on 18 August 2010. Open Systems has submitted a response to the Department of Justice as part of the consultation.
